OUR TERMS & CONDITIONS

A holiday in Italy is different from one in Britain and in addition to the booking conditions below please read through our ‘What To Expect’ page for information and guidance on what to expect with villas and holidays in Italy

1. General

Bookings are arranged by Traditional Tuscany Ltd in the name and on behalf of the Owners of the properties. The contract for the booking will be between you the Party Leader and the Owner of the property and shall be deemed to be made subject to these Booking Terms and Conditions. Traditional Tuscany act as Agents for Owners, and are not Principals.

2. Changes to these terms

Traditional Tuscany reserves the right to revise these terms at any time by updating this page. Please refer to this page from time to time to take note of any changes as they are binding on you.

3. Bookings and payments

All booking requests, including those made on our website are considered provisional until we have received your deposit payment and have issued you with a confirmation that your booking has been successfully confirmed by the Owner. This will usually be within 2 working days from the receipt of your booking request.

The Owners and their Agents have the right to refuse any booking.

The party leader is the person in whose name the booking is made and to whom all correspondence and invoices will be addressed. The party leader is responsible for the booking and must be at least 18 years at the time of booking. The party leader must be authorised to make the booking on the basis of these Booking Conditions by all other members of the booking party. By making the booking, you confirm that you are so authorised and that all other party members agree that the booking is subject to these Booking Conditions.

A non-refundable 30% deposit is due at the time of booking unless your rental start date is less than 64 days away, in which case the full rental amount will be due. If you pay a deposit, the balance of the rental will be due no later than 63 days before the commencement of the rental. If the balance of payment is not made by the due date, as shown on your booking confirmation, your booking may be deemed to be cancelled and cancellation terms will apply.

Payments can be made by Debit Card, Credit Card or Bank transfer. A 2% surcharge is payable for payments made by Credit Cards.

4. Prices

The rental prices issued on our website are in GBP (British Pounds) and are based on prevailing exchange rates and settlement to the Owner in their local currency. We reserve the right to correct errors in both advertised and confirmed prices and to modify prices where necessary including but not limited to circumstances due to fluctuations in exchange rates and where changes are introduced by service providers.

5. Price Changes After Booking

Changes in exchange rates mean that the price of your Holiday may change after you have booked. However there will be no change within 42 days to the commencement of your rental. If the prices quoted on our website have been increased due to fluctuations in the value of Sterling against the Euro, we reserve the right to impose a surcharge on the total of your balance. This charge will be a percentage directly proportional to the increase in the prices quoted on the website for the week(s) of your booking. We will absorb and you will not be charged for any increase equivalent to 2% of the price stated on your original invoice. You will be charged for the amount over and above that. If this means that you have to pay an increase of more than 10% of the price stated on your original invoice, you will have the option of accepting a change to another holiday if we are able to offer one (we will refund any price difference if the alternative is of a lower value), or cancelling and receiving a full refund of all monies paid to us, except for any amendment charges or credit card surcharges.

6. Arrival & Departure Times

The arrival and departure times for your property are indicated in the individual property description under the Prices/Availability section tab. Please do not arrive at your accommodation early without a prior agreement with the Owner as you may not be able to gain access until the designated arrival times. Similarly, late arrivals will only be accepted with the owners consent and may be subject to a late arrival fee if any special arrangements have to be made for you. Guests who arrive after the designated arrival times without having made any special arrangements and having the owners acceptance in advance, may not be able to gain admittance to the property until the following day. You will be responsible for any extra costs.

7. Security Deposit

The Owner may require payment of a security deposit to cover against any damage or breakages that may occur during your stay or for any extra cleaning that may be required if the property is left dirty or in an unreasonable state. The Party Leader is responsible for the behaviour of all members of their party and as such is liable for any damages caused to the property, its contents or the grounds by any member of their party. You are asked to inform the Owner about any damage or breakdown immediately so that replacements or repairs can be effected as soon as possible. The security deposit can be paid in EUR or GBP directly to the owner and the amount payable is shown in the property description under the Prices/Availability tab and on your accommodation vouchers. The security deposit will be returned to you at the end of your stay less any deductions made in accordance with these terms and conditions.

In some instances the security deposit will held by Traditional Tuscany on behalf of an Owner. Where this applies we will require your credit or debit card details and authorisation so that in the event of a claim, the cost may be paid by card. Please note a non-refundable 2% surcharge will apply to any payments made by credit card.

Any costs for loss or damage caused by your failure to respect the property and its grounds will be deducted from your security deposit. You are responsible for paying any bills incurred during your stay. Should any bills not be settled in full on completion of the rental, any outstanding amounts will be deducted from your credit card or billed to you by Traditional Tuscany on behalf of the Owner and will be subject to an administration charge of £30 and any associated collection costs.

Any damage, breakage, or anything giving cause for concern noticed on taking occupancy of the property, must be reported to the Owner within 24 hours of your arrival.

8. Occupancy & Care of Property

The property will been reserved for the person named on the booking form and the number of people occupying the property must not exceed the number stated on your booking confirmation. You must notify us of any known changes to your party numbers before travelling. Any changes notified after your accommodation vouchers have been issued will be subject to payment of an administration charge of £30 and any associated costs imposed by the Owner. The owner will be within their rights to refuse entry or request an additional charge if you increase your party numbers without having made any prior arrangement to do so.

Properties will be clean and in good order when you take up occupation and should be left in the same condition on the day of your departure with washing up done and all rubbish removed. You must inform the Owner of any damage to the accommodation or its contents. You may be required to pay for any damage or missing items or for any extra cleaning if the property is left in an unreasonable condition.

The Party Leader is responsible for the behaviour of all members of their party. The Owner reserves the right to evict you and your party without compensation in the case of anti-social behaviour, unreasonable breakages, if smoking restrictions are not observed, if you are causing a fire risk, if the accommodation is being misused, if you behave in a manner that causes a disturbance or a nuisance to neighbouring properties or other guests or if there is a breach of these terms and conditions. In such instances no refunds will be provided.

9. Cleaning Fees

Some owners levy a compulsory cleaning charge that is payable locally. Where a cleaning fee is charged it is indicated in the property description and is payable directly to the Owner in Euro.

10. Descriptions, Standards and Services

Every effort is made to ensure the standard described for each property and that all items of equipment supplied by the owner are maintained in good working order. However, no guarantee is given or liability accepted if any breakdown occurs or for any damage inflicted by a previous tenant, for which there has not been time to remedy. If during your holiday any mechanical equipment such as boilers, refrigerators, pool pumps etc. breakdown, you must notify the owner to inform them of the problem. If you are unable to contact the owner, then you can contact us and we will contact the owner on your behalf to get the fault corrected as soon as possible. Please bear in mind that getting faults corrected can take some time, particularly if they occur on a Sunday or public holiday. Whilst we will endeavour to assist if the property owner is not available, Traditional Tuscany cannot be held responsible for such breakdowns as we act only as agents for the property owner. You should be aware that in Italy, occasional problems in relation to public utilities such as electricity and water can be experienced.

Where internet is an advertised facility its provision is subject to availability and network conditions and no guarantee is given or liability accepted regarding speeds or the reliability or availability of the service.

Bed linen and bathroom towels are provided and included in the price unless a surcharge payable locally is indicated in the property descriptions. Household linen and towels must not be taken outside. Beach/pool towels and cot linen are not usually provided unless they are indicated as being supplied in the property description.

All of the information given in these booking conditions and in the descriptions of the properties is given in good faith. However, Traditional Tuscany cannot be held responsible for modifications or changes introduced by property owners without our knowledge. Please also note that neither the owners or Traditional Tuscany can be held responsible for external issues that are beyond our control, such as local building works.

11. Swimming Pools & other onsite facilities

Children should be supervised at all times. You are reminded that there are no lifeguards at the swimming pools and it is absolutely forbidden to dive into pools unless otherwise stated. For safe use of swimming pools and other facilities we recommend clients to observe all property regulations. The use of any facility including swimming pools is entirely at your own risk and neither the property owner or Traditional Tuscany can be held responsible for any accident, loss or damage which may be sustained by you or any member of your party or any visitor to the property howsoever caused.

12. Pets

Pets may be accepted in some properties subject to the prior approval and consent of the property owner and acceptance of their pet policy. You are responsible at all times for the behaviour and cleanliness of your pet and they must not be allowed to cause a nuisance to neighbouring properties or other guests. Where pets are allowed the owners pet policy must be observed.

13. Changes and Cancellations by You

If after a confirmed booking is made you wish to amend or change your booking, we will do all that we can to accommodate your request, but it may not always be possible. Any such changes or amendments can only be accepted with the agreement of the Owner and will be subject to any additional costs imposed by them along with our administration fee of £30. Any accommodation changes made with less than 64 days to the start date of your rental may be treated as a cancellation and new booking and incur cancellation fees.
Cancellations must be made in writing by the Party Leader. The following cancellation penalties will apply only after we have received and acknowledged your written notice of cancellation:
- More than 63 days to the commencement of the rental - the deposit
- Less than 64 days to the commencement of the rental - 100% of the total rental price.
Cancellation fees will also apply where you cancel part of a stay. For example, where you have booked a two week stay and cancel one of the weeks, cancellation terms will apply to the cancelled week.

14. Changes and Cancellations by the Owner

We will inform you as soon as reasonably possible if the Owner needs to make a significant change to your confirmed arrangements or to cancel them. We will liaise between you and the Owner in relation to any alternative arrangements offered by the Owner (if any) but we will have no further liability to you. In the event the booking is cancelled by the Owner and no alternative can be offered we will refund all monies we have received from you at the date of cancellation but you shall have no further claim against the Owner or Traditional Tuscany.

15. Force Majeure

Neither Traditional Tuscany or the Owners can be liable for "force majeure" and events outside our control including but not limited to storm damage, flood, sudden invasion of pests, failure of public utility services, mechanical breakdown, war, threat of war, terrorist activity or threat, riot, industrial dispute, natural or nuclear disaster, fire, adverse weather.

16. Complaints

Traditional Tuscany act solely as agents for the Owner and in the event that you have any problems during your stay, it is your responsibility to report the matter to the property owner and give them the opportunity to put things right. If the problem cannot be resolved with their assistance in a reasonable time, you should contact Traditional Tuscany and we will liaise with the owner on your behalf. In the unlikely event that the owner is unable to resolve a problem to your satisfaction, then you must contact Traditional Tuscany and confirm the details of your complaint in writing whilst you are still occupying the property. If you fail to notify the owner or Traditional Tuscany of any dissatisfaction during your occupation of the property, or abandon the property without our agreement you void your right to claim compensation or a refund of rental charges. Neither the Owner or Traditional Tuscany will offer any remedy for any issues, problems or complaints that are raised retrospectively.

17. Tourist Taxes

Where applicable, tourist taxes are not included in the rental price and must be paid locally in Euro.

18. Holiday Insurance

Neither Traditional Tuscany or the Owner have any liability to you or any member of your party for any loss (including but not limited to loss of enjoyment), accident, injury, illness, death which may be sustained by the Party Leader or any member of your party or any visitor to the property howsoever caused. We recommend you take out a holiday insurance that has adequate Personal Travel, Personal Injury and Cancellation Cover.

19. Law and Jurisdiction

These booking conditions and any agreement to which they apply are governed in all respects by English law. Any dispute, claim or other matter which arises between us out of or in connection with your booking will be dealt with by the Courts of England and Wales only.

20. Acceptance of Booking Conditions

When you make a booking through our web site, by telephone or in writing with payment by credit, debit card or bank transfer, you will be deemed to have accepted these terms and conditions without exception or reservation. Your statutory rights are not affected.
